Terms & Conditions

Please read these Terms and Conditions of Use (“Terms”, “Terms and Conditions”) carefully before using the https://digitaltransormationtool.com Digital Transformation Tool (“Digital Transformation Tool”or “DTT”). These Terms and Conditions apply to the use of the DTT, the content of the DTT and any services which can be accessed or purchased through the DTT (“Services”). 


In these Terms and Conditions, use of the terms “Olive Media”, “Olive Group”,”Olive”, “us”, “our” or “we” refers to Olive Media (Australasia) No 1 Pty Ltd ABN 28 035 196 286 T/A Olive Media and Olive Group as the owner of the DTT, and the terms “you” and “your” refer to the user or viewer of the DTT.


By accessing or browsing this DTT or by using any of the Services, you agree to comply with and be bound by these Terms, which together with our Privacy Policy govern the DTT’s relationship with you in relation to your use of this DTT or any of the Services. 


By accessing or using the DTT, you agree to these Terms and Conditions on behalf of yourself and/or the organisation on whose behalf you are accessing the DTT, and you warrant that you are authorised to do so.

 

  1. PURCHASES
    If you wish to purchase any product or service made available through the Service (“Purchase”), you may be asked to supply certain information relevant to your Purchase including, without limitation, your full name, email address, school address and/or credit / debit card information.
     

  2. PRIVACY
    Olive Group’s Privacy Policy applies to use of this Website. Additionally, by using the DTT, you acknowledge and agree that internet transmissions are never completely private or secure. You understand that any message or information you send to the DTT may be read or intercepted by others, even if there is a special notice that a particular transmission (for example, credit card information) is encrypted.
     

  3. ACCOUNTS, PASSOWORDS, AND SECURITY
    Certain features or services offered on or through the DTT may require you to open an account (including setting up a username and password). You are entirely responsible for maintaining the confidentiality of the information you hold for your account, including your password, and for any and all activity that occurs under your account as a result of your failing to keep this information secure and confidential. You agree to notify Olive Group immediately of any unauthorised use of your account or password, or any other breach of security. You may be held liable for losses incurred by Olive Group or any other user of or visitor to the DTT due to someone else using your username, password or account as a result of your failing to keep your account information secure and confidential.

    You may not use anyone else’s username, password or account at any time without the express permission and consent of the holder of that username, password or account. Olive Group cannot and will not be liable for any loss or damage arising from your failure to comply with these obligations.
     

  4. LINKS TO OTHER WEBSITES
    The DTT or the Services may contain links to third-party web sites or services that are not owned or controlled by Olive Group.  This does not necessarily imply sponsorship, endorsement, or approval or arrangement between the DTT and the owners of those websites.

    Olive Group has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that Olive Group shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services. This includes, but is not limited to, the transmission of any malware. Olive Group recommends that prior to using any downloaded files you carry out an appropriate virus check.

    You must not create or maintain any link from another website to this Website without our written consent. To obtain consent, please contact us via the contact form on the Website.
     

  5. YOUR USE OF THE WEBSITE
    You may not use any “deep-link”, “page-scrape”, “robot”, “spider” or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the DTT or any Services, or in any way reproduce or circumvent the navigational structure or presentation of the DTT or any Services, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the DTT. Olive Group reserves the right to bar any such activity.

    You may not attempt to gain unauthorised access to any portion or feature of the DTT, or any other systems or networks connected to the DTT or to any Olive Group server, or to any of the services offered on or through the DTT, by hacking, password “mining” or any other illegitimate means.

    You may not probe, scan or test the vulnerability of the DTT or any network connected to the DTT, nor breach the security or authentication measures on the DTT or any network connected to the DTT. You may not reverse look-up, trace or seek to trace any information on any other user of or visitor to the DTT, or any other customer of Olive Group, including any Olive Group account not owned by you, to its source, or exploit the DTT or any service or information made available or offered by or through the DTT, in any way where the purpose is to reveal any information, including but not limited to personal identification or information, other than your own information, as provided for by the DTT.

    You agree that you will not take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the DTT or Olive Group’s systems or networks, or any systems or networks connected to the DTT or to Olive Group.

    You agree not to use any device, software or routine to interfere or attempt to interfere with the proper working of the DTT or any transaction being conducted on the DTT, or with any other person’s use of the DTT.

    You may not forge headers or otherwise manipulate identifiers in order to disguise the origin of any message or transmittal you send to Olive Group on or through the DTT or any service offered on or through the DTT. You may not pretend that you are, or that you represent, someone else, or impersonate any other individual or entity.

    You may not use the DTT or any Content for any purpose that is unlawful or prohibited by these Terms of Use, or to solicit the performance of any illegal activity or other activity which infringes the rights of Olive Group or others.
     

  6. INTELLECTUAL PROPERTY
    Aside from any intellectual property that is subject to Creative Commons, other materials displayed on the DTT, including without limitation all learning materials, information, illustrations and other graphic materials, logos, coding and trademarks, are the property of Olive Group and are protected by copyright and other intellectual property laws. Any such content may be displayed and printed solely for your personal, non-commercial use within your organisation provided that any copyright notice on such a display or page is not removed. You agree not to reproduce, retransmit, distribute, disseminate, sell, publish, broadcast or circulate any such material to any third party without the express prior written consent of Olive Group.

    Save for the above, and unless expressly granted, Olive Group does not grant any licence or right in, or assign all or part of, its intellectual property rights in the content or applications incorporated into the DTT or in the user interface of the DTT.
     

  7. LIMITATION OF LIABILITY
    Except where prohibited by law, Olive Group will not be liable to you for any loss or damage (including indirect, consequential, exemplary, incidental or punitive damages or loss of profits) you might suffer relating to your use of the DTT or the Services whether from errors or from omissions in our documents or information, any goods or services we may offer or from any other use of the DTT. This includes your use or reliance on any third-party content, links, comments or advertisements. Your use of, or reliance on, any information or materials on this website is entirely at your own risk, for which we shall not be liable.It shall be your own responsibility to ensure that any products, services or information available through this website meet your specific, personal requirements. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.
     

  8. DISCLAIMER
    To the fullest extent permitted by law, Olive Group absolutely disclaims all warranties, expressed or implied, including, but not limited to, implied warranties of merchantability and fitness for any particular purpose. Olive Group gives no warranty that the documents, goods or services will be free of errors, or that defects will be corrected, or that our DTT or its server is free of viruses or any other harmful components.

    Whilst we, at all times endeavour to have the most accurate, reliable and up-to-date information on the DTT, we do not warrant or make any representations regarding the use or the result of the use of any document, product, service, link or information in its website or as to their correctness, suitability, accuracy, reliability, or otherwise.
     

  9. WHOLE AGREEMENT
    These terms and conditions represent the whole agreement between you and Olive Group concerning your use and access to the DTT and your use and access to the documents and information contained on the DTT. No other term is to be included in this agreement except where it is required to be included by any legislation of the Commonwealth or any State or Territory. All implied terms except those implied by statute and which cannot be expressly excluded are hereby expressly excluded.
     

  10. EXCLUSION OF UNENFORCEABLE TERMS
    Where any clause or term above would by any applicable statute be illegal, void, or unenforceable in any State or Territory then such a clause shall not apply in that State or Territory and shall be deemed never to have been included in these terms and conditions in that State or Territory. Such a clause if legal and enforceable in any other State or Territory shall continue to be fully enforceable and part of this agreement in those other States and Territories. The deemed exclusion of any term pursuant to this paragraph shall not affect or modify the full enforceability and construction of the other clauses of these terms and conditions.
     

  11. JURISDICTION
    These Terms of Use and this website are governed by the laws of Queensland, Australia and you agree to submit to the exclusive jurisdiction of the courts of the state of Queensland. 
     

  12. CHANGES
    We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision to the Terms will materially affect your rights, we will use our best endeavours to provide at least 30 days’ notice to you prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to use the DTT, you accept the Terms and Conditions as they apply from time to time. A copy of the current Terms and Conditions will be displayed on the DTT at all times.
